Article 1 General Information

These Terms and Conditions govern all bookings and services provided by Boat Charter Companies, owned and operated by Christopher Przybyl, registered under SIRET 851 067 702 000 23, located at 6 impasse Hodge maurille, cul de sac 97150 Saint-Martin, French West Indies.

By confirming a booking, the client acknowledges having read and accepted these Terms and Conditions in full.

Article 2 Bookings & Reservations

All reservations must be made via the website, by phone, or by email. A booking is confirmed only upon receipt of a deposit of 20% of the total amount due. The remaining balance is due before departure.

Boat Charter Companies reserves the right to cancel any unconfirmed reservation.

Article 3 Pricing

All prices are quoted in euros (€) or US dollars ($) and include the following: the captain, fuel, open bar (beer, rosé, spirits & cocktails), water toys (paddle board, floating mat, noodles), fresh water shower on board, and shade cover.

Prices do not include gratuities, additional food, or any services not explicitly listed at the time of booking.

Article 4 Cancellation Policy

Cancellation by the client:

  • More than 7 days before departure: full refund of the deposit.

  • Between 3 and 7 days before departure: 20% of the deposit is retained.

  • Less than 72 hours before departure: the deposit is non-refundable.

  • Same day cancellation or no-show: the full amount is due.

Cancellation by Boat Charter Companies:

In the event of cancellation due to technical failure or circumstances within our control, the client will receive a full refund or the option to reschedule at no additional cost.

Article 5 Weather & Force Majeure

The safety of our clients is our absolute priority. Boat Charter Companies reserves the right to cancel or modify any outing in the event of adverse weather conditions, strong winds, or any situation deemed unsafe by the captain.

In such cases, the client will be offered a full refund or the option to reschedule. Boat Charter Companies cannot be held liable for cancellations due to weather or force majeure events beyond our control, including but not limited to storms, hurricanes, or sea conditions deemed dangerous.

Article 6 Captain's Authority

The captain holds full authority over the vessel at all times. His decisions regarding navigation, safety, and itinerary are final. Any client who fails to comply with the captain's instructions may be refused boarding or removed from the vessel without refund.

Article 7 Client Responsibilities

The client agrees to:

  • Arrive at the agreed meeting point on time. A delay of more than 30 minutes without prior notice may result in cancellation without refund.

  • Respect the vessel, its equipment, and all safety instructions.

  • Ensure that all members of their group are aware of and comply with these terms.

  • Declare any medical condition or physical limitation that may affect participation prior to departure.

Article 8 Capacity & Safety

Each vessel has a maximum passenger capacity set by maritime regulations. Under no circumstances will this limit be exceeded. All passengers are required to comply with onboard safety rules as directed by the captain.

Article 9 Alcohol Policy

Alcohol is served responsibly on board. Boat Charter Companies reserves the right to refuse service to any person who appears intoxicated or whose behavior poses a risk to the safety of others. Excessive consumption of alcohol that leads to disruptive behavior may result in early return to port without refund.

Article 10 Liability

Boat Charter Companies holds valid maritime liability insurance. However, the company cannot be held responsible for personal belongings lost, stolen, or damaged during the charter. Clients are encouraged to ensure their personal effects and, where applicable, take out personal travel insurance prior to departure.

Article 11 Children & Minors

Children are welcome on board. It is the sole responsibility of the parent or legal guardian to supervise minors at all times. Life jackets are available for children upon request and are strongly recommended.

Article 12 Governing Law & Disputes

These Terms and Conditions are governed by French law. In the event of a dispute, the parties will seek an amicable resolution in the first instance. Failing that, exclusive jurisdiction is granted to the competent courts of Saint-Martin, French West Indies.
